ASHP is calling for the Health Resources and Services Administration (HRSA), part of the Department of Health and Human Services (HHS), to take immediate action against Eli Lilly’s requirement that hospitals and health systems submit extensive claims-level data before they can receive discounted prices under the 340B Drug Pricing Program.
ASHP’s request follows Lilly’s announcement that the company will unilaterally cut off access to legally required 340B drug discounts for safety-net providers that do not turn over their proprietary data. Lilly’s actions disregard its clear obligation to make these discounts available to safety-net providers under federal law.
“Manufacturer demands for claims data as a condition of accessing drug discounts disregard federal law and cannot be allowed to stand,” said ASHP Executive Vice President and CEO Samuel V. Calabrese, MBA, RPh, CPEL, FASHP. “By restricting access to 340B savings, manufacturers are padding their own bottom lines at the expense of safety-net providers and the patients they serve.”
